Terms of Service

1. Agreement

These Terms of Service set out the standards for using CappuPoochie.com and the CappuPoochie game. CappuPoochie.com is owned and operated by CO2 Consulting Group, Inc. ("we" or "us"). By using this website you (the "Member") agree to these terms. If you do not agree, please stop using the site. We may modify or update these terms at any time. Changes take effect when they are posted here, and continued use of the site after a change means you accept it.

2. The service

CappuPoochie.com is a free game where members collect, protect, grade, merge and trade digital cards. You provide your own equipment, your own internet connection and any fees for it. The cards, Credits, Biscuits and everything else in the game have no cash value, and none of it is an investment, a currency or a financial product of any kind. Nothing in the game can be bought with money. The only exceptions are PRO and optional tips, both through Ko-fi and described below, and neither buys cards, packs or Credits.

3. Beta

The game is in testing. A change to how cards, packs or accounts are stored may mean the server has to be reset, and every collection with it. Credits, supplies, scores, streaks and cards held during testing are test balances, not promises. We will warn you first where we can.

4. Accounts

You are responsible for your own account and anything that happens under it. You must give an accurate email address when you register, and you must confirm it before you can trade or sell. You must be at least 13 years old, and signing up includes confirming that you are. One account per person: feeding one account from another is not allowed and can get an account frozen.

5. Credits, Biscuits and cards

Credits and Biscuits are earned by playing. They cannot be bought, sold for money or given away, and they have no value outside the game. Every card is earned the same way by every collector. Holding a digital card gives you that digital item in the game. It does not transfer the copyright in the artwork, which stays with its artist or the public domain. Some cards use AI-generated art, and they are marked as such.

6. Trading and the Market

Collectors can trade cards with each other and list copies on the Market for Credits. Trades and Market sales are between those members. A trade is final once it is accepted. We are not a party to any trade, we do not guarantee the value or authenticity of anything traded, and we are not responsible for disputes between members over a trade. You may not buy or sell anything in the game for real money.

7. The arcade

The arcade's games, including the slots, Risk It, Bingo and the Latte Lotto, are for entertainment. They are played with Biscuits or Credits, which have no cash value, and nothing won in them can be cashed out for money.

8. PRO membership and tips

PRO is an optional $5 a month membership paid through Ko-fi, an outside service, and tips on Ko-fi are optional too. Ko-fi handles billing and cancellation under its own terms. PRO is a way of saying thank you. It does not buy cards, packs, Credits or better odds.

9. Conduct and profile notes

Collectors who follow each other can leave short notes on each other's profile walls. Each person is responsible for what they write, and we are not responsible for notes or messages members send each other. You agree not to use the service to:

Notes can be reported. We have the right, but not the obligation, to remove any note or content and to retire any account for breaking these terms or for anything that harms the game or other collectors, with or without notice. When an account is retired, its cards go back into circulation through the sets' chests. We may keep and disclose information when the law requires it, or when we believe it is needed to enforce these terms or to protect the rights, property or safety of the site, its members or the public.

10. Disclaimer of warranties

The site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, CO2 Consulting Group, Inc. makes no representations or warranties of any kind, express or implied, about the use of this site or its results, including its correctness, accuracy or reliability, and disclaims all implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the site or any collection will continue to exist or be available, or that it will be uninterrupted, timely or secure. Some places do not allow the exclusion of implied warranties, so this exclusion may not apply to you.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CO2 CONSULTING GROUP, INC. SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOST DATA, LOSS OF USE, OR LOSS OF ANY CARD, CREDIT, BISCUIT OR COLLECTION, ARISING OUT OF OR RELATED TO THIS SITE OR ANY TRADE BETWEEN MEMBERS, WHETHER IN CONTRACT, NEGLIGENCE, TORT OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some places do not allow the exclusion or limitation of liability for incidental or consequential damages, so some of these limits may not apply to you.

12. Indemnification

You agree to indemnify and hold CO2 Consulting Group, Inc., its parents, subsidiaries, affiliates, officers, agents and employees harmless from any claim or demand, including reasonable attorneys' fees, made by a third party because of your use of the service, your content, your breach of these terms, or your infringement of any right of another.

13. Changes and interruptions

We may change or discontinue the service, in whole or in part, with or without notice. We are not liable to you or anyone else for doing so. The site may be interrupted or affected by factors outside our control.

14. Third-party sites and services

The site links to outside sites and uses outside services, including Ko-fi for PRO and tips, Amazon for the books some sets link to, and Etsy for CappuPoochie merch. We are not responsible for the availability or content of those sites or for your dealings with them, and your use of them is subject to their own terms and privacy policies. 15. Compliance with laws

You are responsible for following the laws that apply to you. You may not use the service in a way that breaks any law or regulation, or send anything that encourages conduct that could be a crime or give rise to civil liability.

16. Copyright and trademark

The site design, text, code and the name CappuPoochie belong to CO2 Consulting Group, Inc., and may not be copied, modified, distributed, scraped or used commercially without written permission. Card art belongs to its artists or is in the public domain, and is credited on each set. Other trademarks that appear on the site belong to their owners and do not imply any endorsement.

17. Copyright concerns

If you believe something on the site infringes your copyright, write to us through the Support page with enough detail to find it, and we will look into it promptly.

18. Governing law

This site is operated in the State of North Carolina. These terms are governed by the laws of the State of North Carolina, without regard to conflict of law rules, and if you use the site you agree to do so under those laws. We make no claim that the site is appropriate or available for use in other places.

19. Other terms

If any part of these terms is found unlawful, void or unenforceable, the rest remains in force to the fullest extent possible. We may assign these terms to a third party in the event of a merger or acquisition. These terms, together with our Privacy Policy, are the whole agreement between you and CO2 Consulting Group, Inc. about CappuPoochie.com and the game. By accepting these terms you also consent to the use and disclosure of your information as described in the Privacy Policy.
